RESIDENTIAL SERVICES
Family Residence
Residence permit can be issued to Turkish citizens, those who are within the scope of Article 28 of Law No. 5901, or foreigners who have one of the residence permits, refugees and subsidiary protection status holders with the following characteristics.
– To his/her foreign spouse,
– His/ hers or spouse’s foreign minor child, – his/hers or spouse’s foreign dependent child,
In case the foreigner requesting a family residence permit has more than one spouse, a family residence permit can be issued only to one of the spouses. However, to all of the foreigner’s children d a family residence permit can be granted. If one of the parents is outside our country when a family residence permit requests are done for the children with joint custody, the consent of theother parent must be submitted. Family residence permit provides the right to education up to the age of eighteen in primary and secondary education institutions without obtaining a student residence permit.
Foreigners with a family residence permit may request a short-term residence permit in the following cases:
* In case of divorce, if he/she was married to a Turkish citizen and has stayed with a family residence permit for at least three years,
* If the sponsor’s family stays in our country with a residence permit in case the sponsor dies,
* If those who have stayed in our country with a family residence permit for at least three years have completed the age of eighteen; residence permit can be issued in a way not to exceed three years at a time.
Touristic Residence
For this purpose, the statement of foreigners who apply for a residence permit regarding their travel plans (where, when and how long they will stay in the country) is evaluated.
If deemed necessary, he/she may be asked to submit information or documents.
* In the renewal of touristic residences, renewal is made after the purchase of real estate.
Student Residence
Student residence permit is regulated in Articles 38 to 41 of the Law on Foreigners and International Protection No. 6458. In addition, student residence permits are regulated in articles 35 to 39 of the Regulation on the Implementation of the Law on Foreigners and International Protection.
Who can apply;
– Foreigners who do not have a family residence permit, who will receive primary and secondary education
– Foreigners who will receive education at a higher education institution in our country at the levels of associate degree, undergraduate, graduate, doctorate, Medical Specialization Education (TUS), Specialization Education in Dentistry (DUS).
* The student residence permit only provides the right to support the spouse and children of the student in family residence permit applications. To other relatives about obtaining a residence permit does not confer any rights.
What are the student residence permit conditions;
* In order to issue a student residence permit, foreigners must meet the conditions set forth in Article 39 of the Law. * Submitting the supporting information and documents related to the purpose of stay in Turkey (Article 38 of the Law),
* Not to fall under the scope of Article 7 of the aforementioned Law and to give the address information to stay in Turkey.
Humanitarian Residence
Humanitarian residence permit is regulated in Articles 46 and 47 of the Foreigners and International Protection Law No. 6458. In addition, humanitarian residence permit is regulated in Article 44 of the Regulation on the Implementation of the Law on Foreigners and International Protection.
To whom the residence permit can be issued;
Residence permit can be issued to Turkish citizens, those who are within the scope of Article 28 of Law No. 5901, or foreigners who have one of the residence permits, refugees and subsidiary protection status holders with the following characteristics.
– When it comes to the best interests of the child,
– When the foreigners cannot be made to leave Turkey or it is not considered reasonable or possible for them to leave Turkey, despite the decision to deport them or to ban them from entering Turkey,
– When a deportation decision is not taken for the foreigner in accordance with Article 55 of the Law,
– When applying to the judiciary against the actions taken pursuant to Articles 53, 72 and 77 of the Law,
– During the continuation of the applicant’s return to the first country of asylum or a safe third country,
– Foreigners who need to be allowed to enter and stay in Turkey for urgent reasons or for the protection of the country’s interests, public order and public security, are not able to obtain one of the other residence permits due to their situation that hinders the granting of a residence permit,
– In extraordinary circumstances.
We can examine a residence permit process under two titles; Initial Application and Extension Application
The information in this section is only valid for foreign nationals who will apply for a residence permit for the first time. The documents required for the first application vary according to the types of residence permits. We can list residence permits as short-term, family, student, humanitarian, long-term and for victims of human trafficking. * The extension application can be made if there are 60 days or less left before the expiry of your residence permit.
Documents Required for Residence Permit Application and Extension Application;
* Residence Permit Application Form – Notarized copy of passport or substitute document
* Four (4) photographs (Taken within the last 6 months, must have a white background and biometric.)
* Statement of having sufficient and regular financial means during the stay (It is declared in the Application Form. The Administration may request supporting documents.)
* Valid health insurance (The insurance period must cover the desired residence permit period.
One of the following is considered sufficient):
– An e-signed/signed and stamped/sealed document obtained from the provincial social security units proving that health services are utilized in Turkey within the scope of bilateral social security agreements.
– E-signed/signed and stamped/sealed provision document obtained from SGK (The provision documents to be brought from SGK should be both supportive and cover all family members.) – Private health insurance (in the policy “ This policy covers the minimum coverage structure determined in the circular on private health insurances to be issued for residence permit requests, dated 06/06/2014 and numbered 9. Please submit the e-signed/signed and stamped/sealed original of your insurance policy at the time of application!)
